1. Scope and Accessibility of Policy

Scope

The Gotedo Subscription and Refund Policy explains the terms of the subscription-based products offered on the Gotedo Platform and how our customers are billed, offers instructions on how you can cancel or change a subscription, and lists the eligibility for a refund for the subscription fees you have already paid.

Accessibility

You can locate the terms of this Policy in the footer of our website and within the subscription page of any of our subscription-based products before purchasing a subscription. Please read this Policy carefully before making any purchase and discontinue the purchase process if you do not agree with the terms of this Policy.

2. Subscription-Based Products

The following products are subscription-based on the Gotedo Platform:

Gotedo Vineyard software

The Gotedo Vineyard software is our enterprise-grade church management software which provides modern comprehensive tools to enable churches manage every aspect of their church operations. 3. Subscription and Billing

Subscription and Fees

  • You must pay the relevant subscription fees before you can access any subscription-based product offered on the Gotedo Platform.
  • If the subscription-based product has a free plan, you can access the product free of charge subject to the features available for the free plan.
  • If any particular subscription-based product or the plan of the subscription-based product allows, you can purchase add-ons (e.g., additional seats, credits, etc.) on top of the subscription for the product, subject to extra subscription fees.

For the purpose of this Policy, both the main subscription fee and any add-on fees are jointly referred to as the Subscription Fee.

Subscription Terms

  • The Subscription Fee you will pay depends on each individual subscription-based product, the terms of the subscription plan you want to pay for, and the length of the subscription period for the subscription-based product.
  • You can find links to the current prices for each subscription-based product in the section Subscription-Based Products above.
  • Additionally, each subscription-based product will disclose its pricing via a pricing table within the product before you purchase a subscription.
  • Each subscription-based product on the Gotedo Platform will provide detailed information about the status and terms of your subscription. you can also access information about your subscription for any subscription-based product by contacting the Gotedo Support team.

Billing Terms

  • According to the subscription plan and billing frequency you chose during your purchase for any subscription-based product, the subscription may be monthly or annual (the Subscription Term).
  • Consequently, Gotedo will charge the Subscription Fee monthly or annually (the Billing Period).
  • The Subscription Fee is always payable in advance.
  • To make a payment, you need to use your credit card or another banking card (if allowed by each respective payment processing provider).

Recurring Payment Terms

  • By purchasing a subscription, you agree that Gotedo will automatically charge your card a fixed amount according to the chosen subscription plan and the total Subscription Fee. This also covers cases of the subscription renewal (Recurring Payment).
  • The Recurring Payment shall be automatically charged from your banking card via the payment method used during the initial subscription at the recurring intervals equal to the Billing Period until the subscription is cancelled.
  • If the base price for your subscription plan or the add-ons for your subscription plan have been updated, Gotedo will charge your card a fixed amount which is equal to the updated Subscription Fee.
  • Gotedo will notify you of any update to your Subscription Fee at least 1 week to the time of your next Recurring Payment. If you do not want to be charged the updated Subscription Fee, please cancel your subscription before the time for your next Recurring Payment.

Renewal Terms

All the time, after its expiration, the Subscription Term automatically renews for successive terms of the same duration if neither you nor Gotedo cancels the subscription. The renewal also leads to the Recurring Payment charge according to this Policy. Gotedo has no obligation to track your subscription or notify you when the Subscription Term is running out, which is your sole responsibility. Your right to cancel the subscription renewals and instructions on how to serve a cancellation notice are explained in Section 5 of this Policy.

4. Change of Subscription

Each subscription-based product within the Gotedo Platform implements its subscription upgrade or downgrade functionality independently. It is your responsibility to confirm if the product you are subscribing to implements subscription upgrade or downgrade functionality.

Subscription Upgrade

  • If supported by the subscription-based product, you can always upgrade your subscription plan or extend the Subscription Term for the product. You can order the upgrade through within the subscription-based product or by contacting the Gotedo Support team for assistance.
  • Once requested, your subscription plan, Subscription Term, Billing Period, and subscription price will change, and you will be billed respectively. If (1) you request the changes to your subscription with an effective date during the active subscription, and (2) the price for the subscription increases following the requested updates, Gotedo will charge you the difference between the new Subscription Fee and the up-to-date remainder of amounts you have already paid.

Subscription Downgrade

  • If supported by the subscription-based product, you can request to downgrade the subscription plan.
  • The new subscription plan and Subscription Term being downgraded to becomes effective after the initial subscription plan plus Subscription Term expires.
  • No refund of the Subscription Fee for the initial Subscription Term shall be provided during a subscription downgrade.

5. Cancellation

Each subscription-based product within the Gotedo Platform implements its self-serviced cancellation functionality independently. It is your responsibility to confirm if the product you are subscribing to implements a self-serviced cancellation functionality. If the product does not implement a self-serviced cancellation functionality, you need to contact the Gotedo Support team for assistance with your subscription cancellation.

Cancellation Request

  • If self-serviced cancellation is supported within the product you are subscribed to, you can cancel your active subscription by clicking on the cancellation button provided within the product. You may be asked to provide the reason for cancellation and other accont-related information.
  • If self-serviced cancellation is not supported within the product you are subscribed to, you need to contact the Gotedo Support team. You must provide affirmative notice of the subscription cancellation, information about an email linked to your account, details of the last Subscription Fee transaction, and the reason for cancellation.
  • For safety or customer success reasons, only the user who paid the active subscription can request for cancellation either via self-serviced cancellation or Gotedo Support.

Cancellation Terms

  • All Gotedo subscriptions are billed in advance in accordance with the applicable Subscription Term and Subscription Fee.
  • Subscriptions will automatically renew on the scheduled renewal date unless you submit a cancellation request prior to that date. It is your responsibility to initiate and complete the cancellation process before the start of the next billing cycle.
  • Cancellation requests submitted after the renewal date are not eligible for refunds.

Cancellation Consequences

Upon cancellation:

  • Your active subscription will be deactivated immediately.
  • You will lose access to the features and benefits of the subscription plan and any data which was created using the features of the cancelled subscription plan.
  • We will provide tools for exporting relevant data out of your account if you want to proceed to close your account.

6. Refund

Unless we are directly obliged by the applicable law, refunds of the Subscription Fee are subject to the Eligibility for Refunds listed below.

Eligibility for Refunds

Refunds may be granted at Gotedo’s sole discretion in the following cases:

  1. Service Issues: The customer experienced significant issues attributable to Gotedo, such as platform bugs or prolonged outages that substantially affected the service.
  2. Monthly Plans: The customer submits a refund request within seven (7) calendar days following the initial purchase of a monthly subscription.
  3. Annual Plans: The customer submits a refund request within thirty (30) calendar days following the initial purchase of an annual subscription.
  4. First-Time Cancellation: The customer cancels any plan for a Gotedo product following the initial purchase of a subscription.

Refund Process

  1. Refunds are issued only upon verification of eligibility.
  2. Refunds must be processed to the same payment method used for the original subscription payment. If that payment method is unavailable, refunds will not be fulfilled. This is an anti-fraud measure which is non-negotiable.
  3. Refunds will be issued without undue delay, typically within 14 days of determining eligibility.

Ineligible Refund Requests

You are not eligible for any refund when:

  1. You partially use or do not use the subscription, any feature of the subscription-based product on the Gotedo Platform, or any other portion of the Gotedo service for any reason. It is the sole responsibility of customer to choose how to utilize our products.
  2. You claim that the Gotedo product you subscribed to does not fit your expectations or business interest, etc., if such request is served beyond the grace periods listed in Eligibility for Refunds and scope of refund eligibility criteria.
  3. You are found to be repeatedly requesting refunds without valid reasons, attempting to exploit the refund policy for personal gain, or provide false information to Gotedo as justification for a refund.
  4. You did not cancel/request for a refund after your initial purchase. Recurring subscription payments are not eligible for refund.
  5. You fail to cooperate with the investigation into a refund request, such as providing requested information, documents, or evidence. It also covers cases when you intentionally withhold material information or provide false information during the refund process. Cooperation is essential to validate the legitimacy of the refund claim and to prevent any potential misuse or deception.
  6. You breached our Terms of Use including using our products for illegal activities.
  7. Gotedo has a reasonable suspicion that the payment was made through fraudulent means, such as stolen credit card information or identity theft.

Chargebacks

  • If you cancel your subscription and you are not eligible for a refund, Gotedo will not permit actual or threatened chargebacks from you, your banks, or credit card companies intended to circumvent this Policy.
  • If you are not eligible for a refund and Gotedo receives a chargeback threat or a chargeback is placed on your payment, Gotedo may share your data, including name, email, the subscription details, paid amounts, billing address, description of the incident, customer communication, audit logs, as well as other necessary details to applicable banks, payment systems, providers, or credit card companies, creditors, or credit bureaus, as well as to any other entities at Gotedo’s sole discretion, to ensure the dispute is solved. Gotedo reserves the right to cease providing any service to you across all our products irrespective of whose favour the chargeback resolution went.

7. Support

8. Cancellation and Refund for EU Clients

Applicability

This Article 8 and special rules apply to the EU residents being consumers under Directive 2011/83/EU only.

Cancellation

You have a right to withdraw from these Terms and cancel your subscription within 14 days from the date of initial purchase without giving any reason. The right is subject to the following conditions:

  • You can use your right to withdraw just once within 14 days from the first purchase of the subscription. This right does not apply to any renewals of the subscription or other recurrent purchases.
  • The right is not prolongable. Once the 14-day period expires, you will lose your right to withdraw the contract and cancel the subscription. Nevertheless, after the expiration of the 14-day period, you can manage the subscription according to Articles 4 and 5 of this Policy.
  • To meet the withdrawal deadline, it is sufficient for you initiate the self-serviced cancellation within the product (if supported) or send a support request for withdrawal before the withdrawal period has expired. For that, you must inform us of your decision to withdraw from the Terms and cancel the subscription. You must include the following information to your request: (i) Your personal full name, (ii) Your church’s name for subscriptions owned by a church, (iii) Email address connected to your account, (iv) Your physical address, (v) Details on the subscription you want to cancel, and (vi) Date of purchase of the subscription. To satisfy the requirement, you can find information for (v) and (vi) sections in a receipt you received upon the payment.

Your Acceptance

  • Please read this Policy carefully before making any purchase and discontinue the process if you do not agree with the terms of this Policy.
  • By purchasing the subscription across any subscription-based product and accessing the services offered within the product on the Gotedo Platform, you acknowledge and agree that the performance of the service will begin immediately.
  • You understand and accept that once you use your right to access the product on the Gotedo Platform and respective digital content under the license granted according to the Terms, you will lose your right of withdrawal and cancellation within the 14-day cooling-off period as provided by EU consumer protection laws. Therefore, you waive your right to withdraw from the Terms or cancel your subscription once the license has commenced. We will consider your use of the license upon the purchase as your explicit consent to start the services and the withdrawal right waiver.

Effects of Withdrawal

If you withdraw from this contract and cancel the subscription according to this Policy, we will reimburse the respective payment received from you without undue delay and in any event not later than 14 days from the day we received an eligible notice on your decision to withdraw from this contract and cancel the subscription. For the safety reasons, we will carry out such reimbursement using the same means of payment as you used for the initial transaction. In any event, you will not incur any fees as a result of such reimbursement. If the applicable EU law obliges Gotedo to provide refund for some of the Gotedo products and you requested to begin the performance of that service during the withdrawal period, you shall pay us an amount prorated to what has been provided prior to your eligible communication for withdrawal, in comparison with the full price of the respective Gotedo product. Accordingly, you may receive a partial refund.

Anti-Fraud Measures

  • Please note that Gotedo may remit a refund only to the same payment instrument (credit card, wire transfer, etc.) from which the initial payment was made. If the same payment instrument is unavailable anymore, the refund request will be dismissed. This is an anti-fraud measure which is non-negotiable.
  • In a case when Gotedo has reasonable suspicion of potential fraud, money laundering, or illegal cash-out, Gotedo may hold or dismiss a refund.
  • We reserve the right to investigate any suspected fraudulent or suspicious activity related to refunds, including chargebacks or disputed transactions. We reserve the right to limit the amount of refund that can be requested per time.

8. Miscellaneous

Changes and Updates

  1. Gotedo reserves the right to modify or update the Policy at any time. Any changes to the Policy will be communicated to you through appropriate channels, such as the website or email.
  2. Gotedo reserves the right to update the price of any subscription plan across our subscription-based product with or without notice. We will do our best to communicate any changes in price via our websites and email latest seven (7) calendar days to the renewal of your subscription.

Interpretation

The word “including” is to be construed as being by way of illustration or emphasis only and is not to be construed as, nor shall they take effect as, limiting the generality of any foregoing word. A reference to the singular includes the plural and vice versa. All personal pronouns used herein toward natural persons other than the Parties are gender-neutral and shall include all genders. The headings herein are intended to make the Policy easier to understand. The headings do not affect the content and meaning of the provisions placed under the specific headings. Headings are not to be used to interpret the terms of the Policy. Either Gotedo or the Client (you) may be referred to as the Party, and both - as the Parties.
